Order for payment
Polish law allows for the recovery of all financial obligations owed by a debtor to a creditor through summary proceedings.
This is one of the most effective and cheapest ways to recover outstanding debts from a customer or contractor. A payment order issued in the course of court proceedings (but without a hearing) is usually binding, provided that it is not appealed by the defendant. Our law firm will help you obtain a favourable judgment in such cases.
Our legal services are mainly targeted at clients from Warsaw, Bydgoszcz and Toruń, where our network of offices is located. At your request, we will prepare a statement of claim for a payment order. As a creditor, you can demand that the debtor repay their outstanding liabilities, proving the validity of your claims on the basis of one of the documents attached to the statement of claim prepared by us. These include:
- official documentation issued by administrative authorities;
- a correctly completed bill of exchange or cheque, the authenticity of which is not in doubt;
- a VAT invoice or bill accepted by the debtor;
- demands for payment of all liabilities approved by the debtor, as well as demands and formal orders to pay the amount due;
- contracts and proof of delivery of the bill to the debtor, as well as documents proving the performance of a mutual non-monetary service.
The filing of a claim for payment order entails the payment of a fee amounting to ¼ of the amount payable for a regular claim. If the court finds that there are no grounds for issuing the order in a given case, the remaining part of the amount will have to be paid. Then, a date for the hearing is set and ordinary proceedings are initiated.
Payment order – what to do?
The issuance of a payment order by the court results in a letter being sent to the defendant requesting them to pay the amount due as soon as possible. If you believe that the claimant’s claim is unfounded, you can challenge the decision contained in the document within two weeks of receiving it, indicating its incorrectness.
