Representation of creditors in restructuring and insolvency proceedings
Our experience and knowledge of restructuring and insolvency law allow us to effectively safeguard the interests of our clients. RBBC specialists continuously monitor the progress of proceedings and undertake actions to protect the financial interests and legal security of our clients.
Participation in restructuring and insolvency proceedings requires not only detailed legal knowledge but also proficiency in using the ICT system — the National Register of Debtors (KRZ).
We represent creditors before restructuring supervisors and restructuring courts. We submit procedural pleadings, objections and legal remedies. We provide comprehensive services beginning from joining the proceedings, verification of the list of claims and the restructuring plan, followed by recommendations regarding voting on the arrangement and participation in the voting itself.
After completion of restructuring proceedings, at the request of our clients, we monitor the timely performance of arrangement instalments and undertake recovery actions in this respect.
We have extensive experience in proceedings involving an international element and have conducted arrangement negotiations with entities from, among others, Luxembourg, Italy, Germany and Switzerland.
Debt Recovery
RBBC specialists also specialise in the recovery of claims. The scope of our activities begins with preparation of payment demands and direct debt recovery activities — conducting negotiations and agreeing repayment terms.
RBBC also specialises in recovery of difficult claims against entities undergoing restructuring proceedings or threatened with insolvency. Due to our extensive experience in restructuring and insolvency proceedings, RBBC applies a wide range of measures and methods enabling effective recovery even of complex receivables.
Our legal advisers represent clients in payment proceedings before courts, obtain payment orders and participate in enforcement proceedings in order to recover our clients’ receivables as quickly as possible.
Drafting and analysis of agreements and legal opinions
Within our practice, we also specialise in drafting and reviewing agreements. Proper analysis of agreements is particularly important when entering into contracts concerning major undertakings or when assuming financial obligations.
Our specialists ensure that agreements properly protect our clients’ interests and are prepared also for adverse circumstances.
RBBC’s experience in restructuring and insolvency matters, including consumer bankruptcy proceeding allows us to anticipate risks and introduce contractual provisions limiting contractual exposure.
RBBC drafts and reviews construction contracts (including those concluded under public procurement law), lease agreements, sale agreements (including extensive agreements concerning the sale of enterprises), tenancy agreements, supply agreements and other contracts used in commercial practice.
Our specialists also prepare legal opinions. Depending on the needs of the client, our opinions are prepared either in a concise version or in a comprehensive version.
Court disputes and procedural representation
Where it is not possible to resolve a dispute amicably, it becomes necessary to initiate proceedings before administrative authorities or courts. We represent our clients at all stages of proceedings: pre‑litigation, court proceedings and appellate proceedings.

- representation in proceedings concerning transfer of liability for company obligations to members of the management board (public‑law and private‑law liabilities),
- representation in Paulian action proceedings seeking recognition of legal acts (e.g. donations) as ineffective in order to enforce our client’s claims,
