Experience in Large-Scale Restructurings – Gdańsk Case Study

In 2023, the RBBC team conducted one of the largest restructuring processes in Poland under arrangement approval proceedings. The arrangement was approved by the court inGdańskand constituteda highly complexrestructuring process.

The case involved a companyoperatingin the fertiliser industry, cooperating with leading suppliers on both the European and global markets. The scale of operations and the nature of business relationships required consideration of both domestic legal frameworks and cross-border aspects.

The scope of the restructuring included in particular:

  • significant levels of financial liabilities,
  • a large and diverse group of creditors, including foreign entities,
  • the need to coordinate activities across multiplejurisdictions,
  • the preparation and implementation of a comprehensive restructuring plan.

Arrangement Approval Proceedings (PZU)
The most flexible and fastest form of restructuring, particularly effective when properly prepared.
Accelerated Arrangement Proceedings (PPU
Provide court protection and stabilisation while allowing the debtor to retain management control.
Arrangement Proceedings (PU)
Used in cases requiring detailed verification of claims and resolution of disputes.
Sanation Proceedings
The most advanced form of restructuring, enabling comprehensive operational restructuring measures.
